Sent to Central Bedfordshire Council less than a minute later. Council ref: 395576.

Recently had my front pathway replaced as my old pathway was broken due to the tree roots lifting and breaking it,the roots are also heading for my house foundations and branches are overhanging my house. The roots are also lifting the public pathway which is used by the elderly who use walking aids and are often put of course when pushing their walkers over the roots in the path.

  • I think that I have read somewhere on you web page that if I haven.t had a response within 28 days of my report that I should contact you again, I haven.t had a response/reply and I am deeply concerned about the tree roots.

  • We have work planned to prune the tree - date tbd. However any issues with roots damaging private property has to be handled by our Insurance team. We'd advise contacting your building insurers who will investigate the damages and provide our Insurance team with recommendations. The below is taken from our Tree Policy:

    Tree related subsidence occurs when a tree or trees removes water from a shrinkable clay soil; causing the soil to contract and can result in structural damage to properties. The Highways Department does not accept, as a matter of course, that tree related subsidence is the cause of structural damage to property. Evidence is required to support any claim.
    All claims of subsidence relating to highway-maintained trees are administered by the Councils Insurance Team. Cases of subsidence are often complex and require a broad range of information to be considered adequately as such. The Council requires the following information to investigate a claim of subsidence:
    ? Description of type of damage
    ? Indication of seasonal movement
    ? Levels and distortion survey
    ? Visual evidence of damage
    ? Depth of foundations demonstrated from excavated trial holes
    ? Analysis of soil type under foundation
    ? Presence and identification of tree roots
